Joseph Webber Will




Will of Joseph Webber (spelling may not be accurate, but as in origional)

Know all nen by these present:
That I Joseph Webber of the county of Baxter and State of Arkansas being of Sound disposing mind and memory do make and publish this my last will and Testament.
Item first: It is my will and I hereby direct the Executor of this my last, will and testament to first pay all just debts and funeral expences out of my Estate.
Item Second; I give devise and bequeath to my daughter Sarah Jane Webber(who is a cripple which is the cause of the difference made in her favor) the One forth part of all the lands owned by Me which is in Baxter County and State of Arkansas to Wit; The South East quarter of the North West quarter Section (25) twenty-five. South half North East quarter of Section (25) twenty-five. North half of South East quarter of Section (25) twenty five South East of South East quarter Section twenty five. South West of South East quarter Section (25) twenty-five. North half of North East quarter of Section twenty six all of Township Twenty (20) North Range (14) fourteen West. To have and to hold the same, and to be selected by her without regard to any improvement division to be by acres. I also qive to her the one fourth part of my other estate. The property thus given to my daughter Sarah Jane Webber, is to her, her heirs and assigns forever.
Item Third: after setting apart to my daughter Sarah Jane Webber the property given to her as before stated, I give devise and bequeath to my other children Viz; John J. Webber, Mary E. Pettyjohn, Andrew T. Webber, Martha Wise, Newton Webber, Robert E. L. Webber, Laura E. Webber To have and to hold the same to them to their heirs and assigns forever all of the remainder of the land and personal property of My Estate to be equally divided to them their heirs or assigns.
Itet Fourth; I hereby appoint my friend A. G. Byler as Executor of this my last will and testament.
In testimony whereof I have here unto set my hand and and do publish and declare this to be my last will and testasent in presence of the Witnesses named below this the 25th day of June 1890

Proof Of Will

State of Arkansas
County of Baxter

Personally appeared before Mr. B. M. Hancock Clerk of the County and Probate Courts of Baxer County aforesaid J. B. Smith and M. L. Crownvich to me well known, who being duly sworn say that they are the subscribing witnesses to the foregoing instrument of writing purpoiting to be the last will and testament of Joseph Webber Deceased that said instrument was Executed at the time place and by the person therein named that said Joseph Webber the testor was at the time of signing said instrument upwards of twenty-on years of age and of sound and disposing mind and memory and that in the presence of both these affiants he declared it to be his last will and testament, and subscribed his name thereto in the presence of both of these affiants that at the request of said testator affiants who wrote their names to his said will in his presence and in the presence of each other, that the subscription to the aforegoing instrument of writing are genuine and that said in St____ which is hereto attached is the identical one that affiants so witnessed and saw the said Joseph Webber sign
